A Totally Helpful GIF Guide for NYC Rookies

If you're planning a trip to the Big Apple, you've probably heard the usual advice: snap a picture in Times Square, grab a sandwich at Katz's and remember to fold your pizza when you eat it. Oh, and watch out for the yellow cars — they don't stop.

Nathan Pyle, a freelance artist and television producer, moved to New York five years ago from the suburbs of Dayton, Ohio. He's learned a thing or two about life in the urban jungle since then. Most recently, he's released an animated series of "big city" basics that outline, in almost too-true fashion, what you should really know about the city before you visit.

"Since moving here was my first 'big city' experience, I realized pretty quickly that I was naive about a lot of things most urban dwellers know," he told Mashable. "At first, I looked for some sort of Internet guide on how to best survive the city. I couldn't find one, so I just started chronicling things myself."

He created the animations using Adobe After Effects. The tips are mainly derived from his personal experiences since moving — some of them good, some of them not so good (see: #23).

Pyle said he plans to release another series in the near future, and maybe even branch the idea out to a book or calendar of sorts. As for his one golden rule that trumps all else?

"Stay out of the way," he said with a laugh. "Everyone has a place to go. It's very much a 'I'll punch you in the face — if you don't like it, get out of here!' kind of attitude here. Just staying out of the way has kept me fine."

Ad Illustrates How Sexting Can Ruin a Teen's Life

This public service announcement from the Vancouver-based Children of the Street Society offers a memorable illustration of the dangers of texting.

The campaign, which also included outdoor media and poster handouts in schools, was created as part of the Annual Stop the Sexual Exploitation of Children and Youth Awareness Week. For older readers, the ad will not only conjure up Bob Dylan's video for "Subterranean Homesick Blues" but also this classic shampoo ad from the '80s. For the intended audience, though, it just might prompt a second thought or two.

Is Clipping Articles Fair Use? U.S. Court Says No

The term "fair use" gets thrown around a lot in copyright cases, and it refers to an exception to copyright law that allows for the publication of portions or derivations of a copyrighted work — without the permission of the original creator. On the web, fair use has been used to defend aggregators such as Google News, since they take portions of articles to create a service.

Does that label also apply to a service that does a similar thing, but for a newsletter? A U.S. court recently said it doesn't.

As paidContent describes, a federal court ruled that Meltwater, a Norwegian company that does "news and social media monitoring" was violating copyright with its newsletter service. Meltwater's service scans articles for keywords, then takes the headline, the first paragraph or "lede," and the parts of the story where the keyword appears.

The Associated Press sued Meltwater, saying it was violating the AP's copyright on the articles, and that it needed to purchase a license to serve up its content in this way. Meltwater defended its actions under copyright's fair-use doctrine, saying its newsletter service was doing basically the same thing that Google does every second of every day.

Heavy hitters took sides. The Electronic Frontier Federation backed Meltwater, warning that if the AP was successful in its claim, it would have a chilling effect on innovation and free expression. Meanwhile, The New York Times and others sided with the AP, saying Meltwater was a "free-rider" operating a "wholesale copying and redistribution" service.

U.S. District Judge Denise Cote riled in favor of the AP. While on first blush Meltwater's service doesn't appear to be all that different from Google News, it's all in the details.

The law around fair use inherently allows for flexibility, but whether or not a particular complaint amounts to a violation is dependent on four factors: the purpose of the duplicated content, the nature of the copyrighted work, how much of the original was copied, and the effect on the market.

The first factor — the purpose of the use — is often the most important factor in a fair-use case, and it was so here. In her 90-page ruling, the judge rejected Meltwater's claim that its service was like a search engine, which passes the fair-use test because creating a page with several links changes the context essentially "transforms" the copyrighted work into a different kind of service.

That wasn't the case with Meltwater, the judge said, for three reasons. First, the service acted more like a competitor to the AP than a facilitator, she wrote, pointing to the newsletter's click-through rates on articles, which were less than one-tenth of 1%. By comparison, she said Google News users clicked through 56% of the time, citing a 2009 report from Outsell.

Second, by reproducing an article's lede and keyword sentences in their entirety, Meltwater was essentially taking the "heart" of the stories it was excerpting, rather than serving as a teaser, she wrote. Finally, she believed the newsletter was taking more of the articles than was needed for a "search engine" type of service.

The ruling will certainly be appealed, but it could serve as a precedent in determining where the line is for services that depend on excerpting third-party content.

Google Glass Could Be Subject to Texting-While-Driving Laws

Google Glass fans excited about the prospect of using the technology while cruising about in their car might have a roadblock ahead: An extension of texting-while-driving laws to cover the yet-unreleased Glass device.

Gary G. Howell, a Republican member of the West Virginia legislature, has introduced a bill that would amend a state law forbidding texting-while-driving to also prohibit "using a wearable computer with head mounted display." That language is aimed pretty much right at Google Glass.

Howell's no Luddite — he told CNET's that he's a fan of Google Glass in general. However, he sees his bill as an "extension" of texting-while-driving laws aimed at protecting young new drivers and those around them.

"It is mostly the young that are the tech-savvy that try new things," he said. "They are also our most vulnerable and underskilled drivers. We heard of many crashes caused by texting and driving, most involving our youngest drivers."

While it's uncertain if Howell's bill will gain any traction in West Virginia, it's not hard to see other legislators around the country following his example. Texting while driving caused 16,141 deaths between 2002 and 2007, according to a 2010 study, numbers that prompted many states to outlaw the practice. Google Glass might be seen by lawmakers as just as dangerously distracting.

On the other hand, one can also foresee ways in which Google Glass or a technology like it might provide an "enhanced driving" experience which could boost, not reduce, automobile safety. Hypothetically, a Google Glass-powered GPS view could put navigation information in a location that's actually more convenient than the dashboard. Additionally, Google Glass is heavily voice-controlled, so perhaps the company could add a "driving mode" which would provide audio turn-by-turn directions without any potentially distracting visual elements.

Such predictions of driving-related future features are evidenced by Google's already well-known work towards revolutionizing the driving experience via driverless cars. Google's statement regarding the West Virginia bill also adds weight to this line of thought.

"We are putting a lot of thought into the design of Glass because new technologies always raise new issues," a Google spokesperson told Mashable. "We actually believe there is tremendous potential to improve safety on our roads and reduce accidents. As always, feedback is welcome."

There are plenty of good parts of March: St. Patrick's Day, the first day of spring, spring break, the planning of April Fools' Day jokes. But then there's March Madness.

It's a month filled with endless bracket making. There are brackets for everything — brackets of puppies, TV shows, brackets of brackets, brackets of brackets of brackets. No wonder it's called madness — it's literally maddening.

And for those of us non-b-ball fanatics, it's simply a month of not fitting in. If you don't carry around a crumpled sheet of paper all month referring to it every 10 minutes while jabbering on about stats, you have no relevancy.
